According to Vietnamese law, foreigners who want to work in Vietnam legally need to carry out procedures to apply for a Work Permit. The work permit must clearly show the information of the employee and the information of the enterprise where the employee works. So how it will be when the foreign workers move to work in a new company? Do they need to apply for a new work permit? Or apply for a work permit transfer? What are the regulations on Vietnam work permits when foreign workers move to work in another company?

Pursuant to Clause 2, Article 174 of the Labor Law 2012, when a foreign worker terminates a labor contract at the old company and moves to a new company, the Vietnam work permit will be invalid. Foreign workers need to contact the new company to sponsor them in processing the new work permit, which shows all the information between the employee and the new company. This case is considered as a new employment contract.

When applying the Vietnam work permit for a foreigner to move to a new company, what documents should be prepared?

Documents for granting Vietnam work permit to the foreigner moving to the new company includes:

  • Request form for re-grant work permit, according to the form prescribed by the Ministry of Labor, War Invalids and Social Affairs;
  • 2 color photos of size 4cm x 6cm, white background, straight face, bare head, do not wear colored glasses. Photo taken not older than 6 months by the time of applying work permit;
  • Copy of passport or a valid replacement passport as prescribed by law and the issued work permit (except lost cases);
  • Relevant documents to prove good health status, criminal status, experience qualifications to take on the new job.

After preparing all documents, foreign workers can apply Vietnam work permit at the Ministry of Labor, War Invalids and Social Affairs, or through a service company.
